Scientific and comparative review of a jurisprudential schools of thought on the status of Isteefa-e-qisas

Abstract

Islamic law advocates social justice, and emphasizes the establishment of  a system of justice, and devises a mechanism. Therefore, in this regard, Islamic jurisprudence discusses qisas, hudood, and penalties/punishments.

Islam declares qisas as life and mentions the establishment of a system of justice as the purpose of the revelation of the Prophets and Messengers.

In Islamic law, hudood and qisas can not be suspended. While The Islamic system of justice where it insists on paying the rights of victim, It also prevents aggression and cruelty in enforcing the law on the offender and binds the perpetrator or his guardians or law enforcement agencies to legal jurisdiction.

Therefore, this research article describes  scientific and comparative review of jurisprudential schools of  thought on the status of  Isteefa-e- qisas, and it's related discussions.
